These Terms & Conditions (“Terms”) govern your use of the website voguetiling.com.au (the “Website”), operated by Vogue Tiling & Renovations (ABN 34 686 029 078) (“we”, “us”, “our”). By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website.
01 Scope of these Terms
These Terms apply to your use of the Website only. They do not form the contract for any tiling, renovation or other work, and they do not set out the terms on which we provide services, price work, or warrant our workmanship.
Any work we carry out for you is covered by a separate written quote and/or service agreement. That document governs the work and takes precedence over these Terms in relation to it.
These Terms should be read together with our Privacy Policy, which forms part of them.
02 Acceptable use of the Website
You agree to use the Website lawfully and not to:
- Use it in any way that breaches any applicable law or regulation
- Attempt to gain unauthorised access to the Website, its server, or any connected system
- Introduce viruses, malware or other harmful code
- Probe, scan or test the security of the Website, or circumvent any security, authentication or rate-limiting measure, without our prior written permission
- Use automated systems — including bots, crawlers, scrapers, harvesters or headless browsers — to access, copy, index or monitor the Website, except for search engine crawlers that comply with our robots.txt file
- Extract, mine or reuse Website content for text and data mining, dataset compilation, or the training, fine-tuning or grounding of artificial intelligence or machine-learning systems (see Section 04)
- Copy, reproduce, scrape or redistribute Website content except as permitted in Section 04
- Submit false, misleading, automated or spam enquiries, impersonate another person, or provide contact details you are not authorised to use
- Use our enquiry forms or the contact details published on the Website to send unsolicited commercial or marketing messages
- Use the Website in a way that could damage, disable or impair it, or interfere with anyone else’s use
We may suspend or restrict access to the Website at any time without notice.
03 Enquiry forms and material you submit
- Submitting a form or enquiry through the Website does not create a binding contract for services, and is not an acceptance of any offer.
- Our forms are provided for genuine enquiries. We do not guarantee that a submission will be received, delivered, or responded to within any particular time.
- You must not submit content through the Website that is unlawful, offensive, or infringes anyone else’s rights.
- You should not send sensitive personal information, financial details, passwords or confidential documents through the Website. Our forms are not designed to receive them.
- Where you submit material such as photos or plans, you confirm you have the right to provide it, and you grant us a non-exclusive, royalty-free licence to store and use it for the purpose of responding to your enquiry.
- If you give us feedback or suggestions about the Website, we may use them without obligation or payment to you.
04 Intellectual property
All content on the Website — including text, graphics, logos, images, project photos, video, design, code and layout — is owned by or licensed to Vogue Tiling & Renovations and is protected by copyright and other intellectual property laws.
You may view and print pages for your own personal, non-commercial use. You must not otherwise copy, reproduce, modify, distribute, publish, or use any Website content without our prior written permission.
We expressly reserve all rights in our content in relation to text and data mining and artificial intelligence. Our content must not be collected, stored or used to develop, train, fine-tune, benchmark or ground any artificial intelligence or machine-learning model, or to generate derivative content, without our prior written permission. Access by any automated agent for those purposes is not authorised.
“Vogue Tiling & Renovations”, our logo, and our branding are our trade marks and may not be used without our consent.
05 Accuracy of Website content and imagery
We take care to keep the Website accurate and up to date, but the information on it is published for general information only. We do not warrant that it is complete, current, or free from errors, and we may change or remove content at any time without notice.
In relation to the images, videos and project examples published on the Website:
- Images may be professionally edited or digitally enhanced for lighting, colour and clarity, and may be cropped or styled for presentation.
- Colours, textures and finishes vary between screens and devices.
- Project examples are illustrative of past work only and are not a representation about any future project.
- Any figures, ranges or timeframes published on the Website are general information only, are not an offer or a quote, and may change without notice.
You should not rely on Website content as advice for your circumstances. Anything you need to rely on should be confirmed with us in writing.
06 Cookies, analytics and session recording
The Website uses cookies and similar technologies to function correctly and to help us understand how it is used. In addition to essential cookies, we use the following tools:
Google Analytics 4 and Google Tag Manager
We use Google Analytics 4, deployed through Google Tag Manager, to measure how visitors use the Website — including pages viewed, referral source, time on site, and actions such as submitting a form or clicking a published phone number or email address. This data is processed by Google and may be stored outside Australia.
Microsoft Clarity (session recording and heatmaps)
We use Microsoft Clarity to understand how visitors interact with our pages. Clarity captures behavioural data such as mouse movement, clicks, taps, scrolling and page navigation, and uses it to produce session replays and heatmaps. We use this only to diagnose usability problems and improve the Website — not to identify you personally. This data is processed by Microsoft and may be stored outside Australia. You can read Microsoft’s privacy statement at privacy.microsoft.com/privacystatement.
Your choices
- You can control or delete cookies through your browser settings. Disabling cookies may affect how parts of the Website work.
- You can opt out of Google Analytics across all websites using Google’s browser add-on at tools.google.com/dlpage/gaoptout.
- Blocking third-party scripts in your browser, or using a browser privacy mode or extension, will also prevent this measurement.
By continuing to use the Website, you consent to the use of these analytics and measurement tools. Our Privacy Policy explains in more detail what is collected and how it is handled.
07 Third-party services and embedded content
The Website links to, embeds, or loads content and services from third parties. These currently include:
- Google — Analytics, Tag Manager, Fonts, Maps, and our Google Business Profile
- Microsoft — Clarity analytics and session replay
- A third-party review platform that displays reviews sourced from Google on the Website
- Vimeo — embedded video player
- Social platforms — links to our Facebook and Instagram profiles
- Our website hosting and email delivery providers, who serve the Website and process form submissions
Reviews and ratings displayed on the Website are content authored by third parties and served through a third-party platform. We do not write or edit them and are not responsible for their content or for how that platform ranks, aggregates or updates them.
Embedded content may set its own cookies and collect data about your interaction with it, governed by that provider’s own terms and privacy policy. We do not control and are not responsible for the content, accuracy, availability or practices of these third parties, or of any website we link to. Accessing them is at your own risk. The services used on the Website may change from time to time as we maintain and improve it.
08 Website availability, maintenance and security
We do not guarantee that the Website will be available at all times or without interruption. It may be unavailable during maintenance, updates, hosting issues, or events outside our control. We may change, suspend or remove any part of the Website, including pages, features and content, at any time without notice.
We take reasonable steps to keep the Website secure, but no website can be guaranteed completely secure. If you believe you have found a security vulnerability, please email info@voguetiling.com.au rather than testing or exploiting it.
09 Disclaimer of warranties
To the maximum extent permitted by law, the Website is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Website will be uninterrupted, secure, or error-free.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot be lawfully excluded.
10 Limitation of liability
To the maximum extent permitted by law, we are not liable for any loss or damage (including indirect, incidental or consequential loss) arising from your use of, or inability to use, the Website, or reliance on any content on it — including third-party reviews and embedded third-party content.
Where our liability cannot be excluded but can be limited, our liability is limited to re-supplying the relevant information or service, or paying the cost of having it re-supplied.
11 Indemnity
You agree to indemnify us against any claims, losses, damages or costs arising from your breach of these Terms or your misuse of the Website.
12 Privacy
Your use of the Website is also governed by our Privacy Policy, which explains how we collect and handle your personal information, including through the analytics, session recording and form tools described in Sections 06 and 07.
13 Accessibility
We want the Website to be usable by as many people as possible and use the Web Content Accessibility Guidelines (WCAG) as a guide when we build and update it. We do not warrant that every page fully conforms to those guidelines. If you have difficulty accessing any information on the Website, please contact us and we will provide it another way.
14 Governing law
These Terms are governed by the laws of South Australia and the Commonwealth of Australia. You submit to the non-exclusive jurisdiction of the courts of South Australia.
15 Changes to these Terms
We may update these Terms from time to time, including when we add or change the tools and services used on the Website. The current version will always be posted on this page with the “Last updated” date. Your continued use of the Website after changes are posted means you accept the updated Terms.
